SUBJECT: Information pursuant to Article 13 of Legislative Decree 196/2003 and Article 13 of EU Regulation no. 2016/679.

Pursuant to Article 13 of Legislative Decree no. 196/2003, as amended by Legislative Decree 10 August 2018, no. 101 (hereinafter "Privacy Code"), and Article 13 of EU Regulation no. 2016/679 (hereinafter, "GDPR") containing provisions for the protection of persons and other subjects with regard to the processing of personal data, we wish to inform you that the personal data provided by you to Turistica GiMa. S.r.l., as Data Controller, Via delle Batterie 100 30013 Cavallino-Treporti (VE), Italy - P.iva 00787710276, due to the commercial and contractual relationships between us, will be processed in compliance with the aforementioned legislation and the related confidentiality obligations.

Subject of the processing

This information refers exclusively to the processing of personal, identified, and non-sensitive data (by way of example but not limited to: name, surname, company name, telephone, e-mail (hereinafter also "Data") carried out by Turistica GiMa. S.r.l. within the scope of its commercial and contractual relationships with customers and suppliers. In any case, Turistica GiMa. S.r.l. will process the Data exclusively for the purposes and within the limits indicated in this communication.

Purpose of data processing

The processing is aimed, for the fulfillments required by law, at the correct and complete execution of the commercial and contractual relationships existing within the scope of the respective company activities. In particular, your Data is processed for the following service purposes:

to allow contact by Turistica GiMa. S.r.l. for possible commercial agreements;
to process a contact request for the aforementioned purposes;
to send communication emails regarding the aforementioned commercial relationships and/or otherwise concerning the respective company activities for the purpose of commercial agreements;
to send emails and/or communications of data changes and/or references of Turistica GiMa. S.r.l.

Methods of data processing

The processing can be carried out with or without the aid of electronic or automated tools, in compliance with the provisions of art. 32 of GDPR 2016/679 and Annex B of the Privacy Code regarding security measures. The processing is carried out by the data controller and/or data processors, and in any case by specially appointed subjects and in compliance with the provisions of art. 29 GDPR 2016/679.

We inform you that, in compliance with the principles of lawfulness, purpose limitation, and data minimization, pursuant to art. 5 GDPR 2016/679, subject to your free and explicit consent where required, your Data will be stored for the period of time necessary to achieve the purposes for which they are collected and processed.

Provision of data

It should be noted that for data collected and used for needs related to the execution of activities/services/supplies inherent to a contractual relationship or to respond to direct requests from the data subject or the observance of legal obligations, consent is not required. The failure to communicate the aforementioned data will, therefore, in this case, make it impossible to proceed with the contractual relationship. For data collected and used for the legitimate interest of the Data Controller, your consent is not required (lit. f art. 6 GDPR). The communication of the aforementioned personal data is optional but strictly necessary for the performance of the activities referred to in point 2. Any refusal to provide the data will make it impossible to fulfill the activities referred to in point 2.

Communication of data

We inform you that the collected data may be disclosed to data processors and may be communicated for the purposes referred to in point 2 to external collaborators, subjects operating in the judicial sector, to counterparts and their defenders, to arbitration boards and, in general, to all those public and private subjects to whom the communication is necessary for the correct fulfillment of the purposes indicated in point 2 and for the fulfillment of legal obligations.

Dissemination of data

The data are not subject to dissemination or indeterminate communication without your explicit consent, outside of the hypothesis referred to in the preceding point.

Transfer of data abroad

The management and storage of data will take place in Europe, on servers located in Europe of the Data Controller and/or of third-party companies specially appointed for this purpose and who will, if necessary, be designated as Data Processors. The data will not be transferred to Third Countries not belonging to the European Union.

Data deletion

We inform you that, at any time, you may exercise, pursuant to art. 7 of the Privacy Code and articles 15 to 22 of EU Regulation 2016/679, the possibility of revoking consent at any time, without prejudice to the lawfulness of the processing based on the consent given before the revocation, and subject to cases of mandatory data processing expressly provided for by current Laws. You can request the deletion of your data by sending a specific written request to the Data Controller, i.e., Turistica GiMa. S.r.l. via email (info@enzostellamaris.com) or by post to Via delle Batterie 100 30013 Cavallino-Treporti (VE), Italy. The withdrawal/revocation/cancellation/waiver/right of opposition/interruption/refusal/cessation of consent to the processing of personal data will be stopped when requested and all stored user data collected before the request will be deleted without undue delay and, in any case, within one month of the request.

Rights of the data subject

We inform you that, at any time, you may exercise, pursuant to art. 7 of the Privacy Code and articles 15 to 22 of EU Regulation 2016/679, the exercise of specific rights, including:

to request confirmation of the existence or not of your data and their availability in an intelligible form;
to obtain information about the origin of the data, the categories of personal data, the purposes and methods of processing, the logic applied to the processing, the identification details of the controller and the recipients to whom the data may be communicated and, where possible, the retention period;
to obtain the updating, rectification, and integration of the data, the deletion, the limitation of the processing;
to obtain data portability, i.e., to receive them from a data controller, in a structured, commonly used, and machine-readable format, and to transmit them to another data controller without hindrance;
to object to the processing at any time and also in the case of processing for direct and indirect marketing purposes, market research, and profiling, subject to cases of mandatory data processing expressly provided for by current Laws;
to object to an automated decision-making process relating to individuals, including profiling;
to lodge a complaint with a supervisory authority pursuant to art. 77 GDPR. For Italy, the competent authority is the Guarantor for the protection of personal data, who can be contacted using the contact details on the website www.garanteprivacy.it ;
to revoke consent at any time, without prejudice to the lawfulness of the processing based on the consent given before the revocation, and subject to cases of mandatory data processing expressly provided for by current Laws.

You can exercise your rights by sending a specific written request to the Data Controller, namely Turistica GiMa. S.r.l.. Requests will be processed without undue delay and, in any case, within one month of the request; only in case of particular complexity and the number of requests can this period be extended by a further 2 (two) months.
